If there were any improper trading, I'd think the window for knowledge of this was probably quite narrow. On the CC, Sepracor claimed LLY informed them of their decision last night. So advance knowledge would have to have come from between the time when LLY informed Sepr of the QT issue and last nights decision to return the drug, if in fact, LLY forewarned them at all. LLY was publicly trumpeting the drug in mid August in the aftermath of the patent overturn.

I think Sepracor has handled the situation reasonably. They were blunt regarding the financial and strategic implications of the LLY decision.
