With regard to IE not being "allowed" in Win98 according to the appeals court decision, the courts decision was much more in support of Microsoft's argument than a simple "the case may continue." this is what they said:

On the facts before us, Microsoft has clearly met the
burden of ascribing facially plausible benefits to its integrated design
...
At this stage, then, the Department has not shown a
reasonable probability of success on the merits. Given this failure, there is no reason to allow the preliminary injunction to remain in effect pending a proper hearing, and we reverse the district court's grant.
...
In view of our interpretation of the consent
decree...the Department may well regard further pursuit of the case as unpromising.
