The Wall Street Journal Monday said the tentative agreement reached Friday was the first out of court settlement of a suit since Firestone recalled 6.5 million tires Aug. 9, after reports of tread peeling off the tire casing causing accidents and rollovers. Trial was scheduled to begin Nov. 13. Terms of the agreement were not available. The National Highway Traffic Safety Administration said last week is was investigating more than 3,500 accidents linked to potentially faulty 15-inch Firestone ATX, ATX II and Wilderness AT tires. About 160 deaths worldwide are attributed to the tires, 119 deaths in the United States. Most of the accidents involved Ford Explorers riding on Firestone tires. "The timing certainly helped a lot," attorney Robert J. Patterson told the newspaper. "(Firestone) is doing jury studies and if their studies are showing what ours are, they don't have a chance." The Corpus Christie, Tex., lawyer is representing the families of Patrico and Nidia Leal, who were killed when their Explorer lost control, hit a utility pole and ran into a ditch on a two-lane road near Brownsville May 30, 1999. The Journal said the tire was a Firestone ATX that had been made at Firestone's plant in Decatur, Ill. More than 100 lawsuits have been filed against Ford and Firestone because of accidents linked to tire tread separations. The firms said more than 4.2 million of the recalled tires had been replaced and they expect to complete the recall by the end of November.
