1) SNDK doesn't actually produce any kind of product. Every piece of SNDK memory is created under a "secret" contract with a "third party". All of their license/patent agreements are "secret" too.

2) For all of the money SNDK made with UUMC and spent with Toshiba, SNDK hasn't bothered to share more than cursory details with its shareholders.

3) Individual investors in SNDK haven't a clue as to what SNDK is doing, why they are doing it, or what SNDK will do next. You can hold SNDK for years, read every annual report, and still not have a clue!

4) The "market" doesn't appreciate all this secrecy and has responded by having less than a handful of analysts bother to follow the stock. As a result, "the market" sets a new price for SNDK every day ... based upon its best guess with respect to an unknown quantity.

Aus, I agree completely with Craig's previous post. It is the royalty subject which I believe should be the main point of the letter. This is the great unknown and what is most important to the stock price.

The CC replay has already been addressed. Someone posted an email from Sharon saying they are working on it.

The web site issue is relatively minor. Should it be updated? Absolutely. Does the issue have the importance of the royalties? Not even close.

Eli addressed the code vs data storage last CC. It does need to be repeated to The Street, but it is not worth reiterating in The Letter.

Stick with the royalty issue. It is by far the most important.

I posted this awhile back, but I do feel it would be relevant to include in the letter - SanDisk seems to get lumped into the wrong industry group quite often. I still cringe every time I see the BloombergTV ticker flash SNDK by with the Internet stocks!
