See also Message 14649016 where Ausdauer points out that Lexar has already tried this line of argument to no avail. I don't really know why Lexar's stock is still above $5, given the obtuseness of its management. They could have avoided a lot of nastiness if they would have just paid the royalties, and sold their cards based on speed for a slight premium. They haven't even been able to come close to making money so far without paying royalties, so they are in deep doo-doo. I'll be interested to hear their CC tomorrow night. Lots of belly-aching rhetoric about big bad two faced bullies, I'd guess.
