Microsoft argued that Hites' participation could prolong the case. The company also pointed out that Hites performed research in June on
behalf of rival Sun Microsystems.

I am sensing a lot of relationship building between MSFT and & govt. What is going on. This am they settled with FTC on one matter, later in the day govt and msft voice same opinion. Other day, Balmer said he would love to put this thing behind. Doesn't hurt to be optimistic

Pssst.....John:

I think that they both have concerns about Hites means very little. I do think that it will be very significant if the court admits these 4 amicus briefs from microsoft's competitors.

But, John, don't you remember that 16 Billion Dollar Navy contract thingy about a week ago, using the MS operating system. Did it occur to you that this is the real evidence of the break in the dyke; don't you imagine that there was huge pressure on the Navy to not rely on this......this Monopolist??

The foregoing must be read in the light of and under the Rules of the Securities and Exchange Commission that concern and govern firing from the lip.
