Every major DRAM manufacturer has been sufficiently confident that this was not the case that they have been willing to risk testing it in court - which is always risky and always expensive. As has been pointed out here many times, royalties of a percent or 2 would not be worth the risk of fighting anything more than a very weak case.

Now that NEC and Hitachi are into wafer starts that will postdate the expiration of their agreements with Rambus, it is clear that they agree that Rambus doesn't have a credible case.

If Rambus had a credible case, NEC/Hitachi would have extended their license agreement to the new company - I can't imagine that they weren't being offered incentives to "get the licensing ball rolling" by signing early.

But they've turned down those incentives. The signals are pretty strong that the RAM manufacturers are certain that Rambus has little or no chance of winning.
