Rick,

I think that there is a distinction between the formation of an "association"
and the creation of a "consortium" that pounds out a new standard.

Some may say there are few shades of gray between these definitions,
but I don't think I am making an argument based purely on semantics.

CompactFlash was invented in 1994 by SanDisk before the CompactFlash Association was formed. And wouldn't a consortium work out standards for an upcoming product? Recent examples of the latter may include the Bluetooth standard or even the standards committee that set the specs for the 56K modems a while back.

Again I think the case against SNDK regarding its relationship with the CFA will boil down to the written governances of organization and the sentiment expressed by other CFA members, including the Executive Director, aside from Mr. Reimer and Lexar.

If you look back to the early days of the CFA I believe Mr. Reimer was actually employed by Motorola who (presumably) were developing pager modules for the CF slot rather than flash memory storage. In fact, I don't know for a fact that Mr. Reimer, while acting on behalf of Lexar Media as an employee, participated in the CompactFlash specs.

Maybe someone could call Lexar Media and find out what his role was at the time.

SORRY FOR BREAKING MY PROMISE. THIS IS MY LAST COMMENT ON THE UPCOMING LITIGATION.
