We will see if this new patenting strategy keeps cloners like AMD, Via etc from copying the new instruction features on the IA-64 and IA-32.

If successful this will prevent the software from being compatible between an Intel machine, and the cloned machine.
For the IA-32, this could backfire if software developers decline to incorporate the new instructions. Intel itself is developing new `infrastucture software' like new compilers and development tools,and libraries. These could be Trojan Horses, and the new instructions could creep in to common usage via Intel's tools.
