Maybe he's convinced Bush will continue the case.

I was thinking more along the lines that Scott feels most of the damage has been done for him, in part by him (because he could get away with it-at least partially), along with knowing a Bush administration will not pin Sun with a illegal monopoly status with his DoJ appointees with an out of the air definition of a particular 'market'. I think it's also known as fear; but I can't say that I blame him at all here, but ONLY here. <g>
