You are completely wrong. What you are talking about is Elpida not NEC or Hitachi. Their deals are for 5 years. If they get not to produce anything and Elpida to produce everything, that's a different story and has nothing to do that the NEC & Hitachi deals are for 5 years. In fact, the controllers will still be part of NEC & Hitachi and will continue paying Rambus for the ful 5 years. If also during those 5 years they decide to go back and make memory themselves, that 5 year deal is also there. SO the NEC & Hitachi deal are for 5 years no matter if they do or don't make any DRAM. What you are thinking is the new Elpida company that starts Jan 1st. Elpida will need a new agreement. It's not Jan 1st yet, is it? And Elpida hasn't produced anything yet either. So wait till Jan 1st before you spread your stupid & idiotic FUD.

I disagree entirely.

Elpida will take over the PRODUCT LINES (read sales) and design, but not PRODUCTION. Those will remain in the hands of the parent companies (NEC and Hitachi) for the foreseeable future. From the horses mouth:
