Brian, won't this be interesting to explore at trial?
CRISLER: 6/4/98. 3:00 p.m. David
Humber. "First he heard of it yesterday. After meeting I asked what happened? Van said a couple of hoses were cut. Talked to Cory from Herrera, Archie. 7:00 to 3:30 usual hours. Didn't see anything unusual, but I didn't make the rounds. No strangers. Be surprising why anyone would do that. K told him what happened. Surprised. No the implications. Everybody knows Mike and Sue have a disagreement, but Mike D. would not do anything like that." "Conflict: She turned him in for swearing. He had been swearing for years and years. She even swore. It wasn't directed toward her. I heard that from Mike."
FALCON: Who was that that was talking?
CRISLER: David Humber. Page two. "It's been a year going on hasn't it. I've never seen them talking to each other." David Hodul. "He's worried that she's unstable. Technical difficulty with Jim Fair and Ron Powell. From what I know of Mike. She interrupted our conversation. She was the rude one. I'm not that kind of person. Egoistical personalities that blurt out what they're thinking. For me to see Mike respond that way is normal. Never seen Sue treat him that way. Does he treat you that way? Yes. Burleigh Cooper does it, too."
FALCON: And who is this witness here?
CRISLER: This is still David Humber. Page three. 6/4/98. Dave Humber. "I was asked by Susan if I would testify against Mike. No. I won't. If she took it that way, that's her problem." Hibbs: "Whether or not the victim sees it as harassing."
LIBURT: Hang on just a second. Go on.
CRISLER: "Mike felt harassed by her pushing in on the conversation. I can't imagine would escalate into violence. She's got two new engineers working for her. If Susan wants to get rid of Mike, then she might sabotage her own lab. ..."

Buying VSEA is not without risk !!!

Dear fellow investor, VSEA is embroiled in a costly lawsuit that is alleged by some to have cost Varian $2,000,000 so far!!!

Wow!

Whatever the cost really is, some investors believe the final tally could exceed $50,000,000 !!!

Brian, won't the trial be REALLY interesting now?
"26. Varian, knowing full well that the continued existence of the five weeks of bathroom videotapes would be the best evidence of the truthfulness of Delfino's denial of "harassing" conduct towards Felch, and would be the severely damaging evidence of the invasion of privacy claims of Delfino and other members of the class of persons caught on the videotapes going to the bathroom, has intentionally destroyed, concealed or otherwise disposed of said videotapes so as to avoid Varian being caught "red handed" of unlawful, wrongful and oppressive conduct. The financial incentive for Varian to rid itself of such evidence to avoid full legal liability for compensatory and punitive damages was enormous. Such conduct should be punished and be made an example of, for which punitive damages in the sum of $50,000,000 should be awarded to Delfino and the other class members."

Has VSEA made the multi-million dollar mistake in falsely accusing me:
"DEFENDANTS' CONTINUED DEFAMATORY POSTINGS AFTER THE FILING OF THIS SECOND AMENDED COMPLAINT
43. Following the filing of the Second Amended complaint in this action, defendants have posted, by their own admission, more than one thousand messages relating to this action. In many of these messages the defendants continue to defame and harass Plaintiffs, Plaintiffs' counsel, and other persons whose names have arisen as potential witnesses against defendants, including but not limited to Joseph Phair, Jim Fair, Ron Powell, Jane Crisler, Craig Moro, Jeff Wright, Kathy Hibbs, Dick Levy, Dick Aurelio, and others. In these messages, defendants have defamed Plaintiffs in new ways, such as by insinuating (i) that George Zdasiuk is homophobic; (ii) that Plaintiffs have videotaped persons in company bathrooms, going to the bathroom, using the bathroom, or engaging in private activities in the bathroom, or have otherwise invaded the privacy of persons in the bathroom, (iii) the Plaintiffs are bullies, fascists, tyrants, or seek to oppress free speech, or that this is a SLAPP lawsuit, (iv) that Plaintiffs destroyed or tampered with evidence, (v) that Susan Felch sabotaged a laboratory, (vi) that Susan Felch is 'scary' or has violent tendencies, and (vii) that George Zdasiuk would not have hired a woman employee if he had known she was pregnant. These messages, which the defendants admit posting, include the following:..."
