CB, my law experience is limited to a class in high school and business law in college but what about the arms length search for the safety of the officer when you are stopped? Do they have the right to search under your seat where you may have a concealed weapon? Do they need a warrant to open your trunk? Thanks mike ho ho ho

"Every client I ever had that got busted for simple possession let a cop search his car at a traffic stop. Dumb, dumb, dumb. "

Have you ever been able to figure out why someone who is 'in possesion' says yes to the police when they ask to search? Is it because they think that if they say yes the cops won't bother because of it? I've seen people on teevee shows like COPS do that, and never could figure out what's going through their minds. Why not say, 'don't bother with the effort of searching officer, here's my dope'?

Regards,

Barb

Not that it's anything I've ever had to worry about, but what is the law regarding a car search? I assumed that if a cop wants to search my car, he can do that whether or not I allow it. Or do they have to get some kind of warrant?

Marijuana is tolerated much more now than it was then, in my experience. Marijuana users don't get jail time for a first offense, not here in Fairfax. And you've got to be awfully dumb to even get arrested for marijuana, like smoke in front of a cop. Every client I ever had that got busted for simple possession let a cop search his car at a traffic stop. Dumb, dumb, dumb.

Ho Ho Ho

My "experience" is also that marijuana is definitely tolerated.

A few years ago, a couple of people I knew went down. One punk with a lengthy record with many prior convictions for mostly petty BS was the first to go. No one really knows how he got caught, but he did and found himself between a rock and a hardplace. He was scared and DIDN'T GET A LAWYER and was convinced he'd be up in the state pen if he didn't even the score by tossing the cops a few busts. This lead to a total of 15 people going down as a few more ended up rolling also, about 3 fat cats and the rest were petty dealers. The funny thing was, the whole time the cops weren't interested in busting people and making solid cases. They timed the busts to coincide with the cash payments instead of the actual deals. When all was said and done, they took $200K in cash and about 50 pounds of marijuana (most of the marijuana they didn't know they'd find). Minneapolis has a seperate drug task force that operates on its own. It is also my experiance that these type of entities operate on the border line between government service and corrupt rackateering organizations.

IF they cared, they would've taken a different approach. What kind of message are they sending when they bust a kid with $50K in cash and don't even charge him with anything? If they would've busted the deal, they could've taken over 50 pounds of marijuana and f*cked the kid. They wanted the money though. With a little due dilligence, they could've had a 20 year old kid make a trip to San Diego and show them how they get the sh*t over the border and got the real big shots. But they wanted the quick score, they took the money and let everyone go. When all was said and done, NO ONE got any jail time and most people were never even charged with a crime. The only people that got screwed were the one's that didn't get lawyers right away.

got lawyers? -ggg-
