So, you're saying that the officer only gave Bush a ticket and then let Bush go back into his car drunk to resume driving under the influence and putting himself, his passengers, and others at risk on the road way? I highly doubt that... What incredible liability that would have been on the part of that officer, and I don't believe any officer who stopped a driver that failed a roadside sobriety test would allow the driver to get back into his car and drive away, that would be most incredible.....

I was a law enforcement officer for a number of years and I had full arrest powers, although I appreciate your thoughtful tips on arrest procedure..... BTW, why would you anticipate a cute come back? Sensitive about your reply?

If you are charged with a misdemeanor, you are arrested. You do not HAVE to be handcuffed. I was handcuffed and put in jail. Would you then assume that I was arrested? I was never charged, therefore not arrested. Bush was not only charged, he was found guilty of having a blood alcohol level equal to or above the legal limit. That's a crime.

Say it doesn't matter now, but don't try and say that if he wasn't handcuffed he wasn't arrested. And he did spend 90 minutes in the tank. Do you think they let him drive himself home after that?
