I have no immediate problem with such a proposal.

Just so long as violent act was committed by the defendant, nor was there an intent to commit a violent act.

Putting users in prison is not the answer. Putting the distributors/sellers is. (and I'm not talking about someone scoring a dime bag of weed, but those who traffic anything larger than 1/2 a kilo).

I think you are mixing punishments and crime, throwing in capital punishment, drug offenses, and prison overcrowding.
