IRS must go through special rigamarole to prosecute a church. The IRS does not have a zero tolerance policy. The Pierce Creek case is the only instance in which the IRS has revoked the tax exempt status of a church for political activity. (It has revoked tax exempt status in real estate fraud cases, etc.) You will admit, I suppose, that Pierce Creek was really asking for it. Pierce Creek's big mistake was asking for an exemption letter. Churches that never admit the IRS has any jurisdiction over them get off scot free. Individual contributors may have trouble getting exemptions for their contributions, but I think nothing prevents a non-registered church from claiming tax exempt status.
