Unfortunately for the senate to reject they must show some form of incompetency. They cannot reject on philosophical grounds......

That has been the tradition, but there is nothing in the Constitution to prevent the Senate to deny consent on any grounds it chooses. You shouldn't expect Bush to nominate Democrats, but I think the Dems in the Senate should be assertive in demanding that he nominate moderate judges whose philosophies are well within the mainstream of American jurisprudence: Look, bub. We were elected too, and we actually got pluralities in our races.

Of course at least one or two Republicans would have to join the Democrats to deny confirmation given the current makeup of the Senate, but as I understand it, a minority of 41 can block confirmations indefinitely.
