I sort of agree with you and they do know who voted in the first place. The registry of eligible voters is a document that could be used to make sure that no new voters could vote. But, I believe that would be unconstitutional. So, the judge has only 3 options:

1. Do nothing and declare the rsults the results;
2. Void those ballots marketed for Buchanan and keep the other 19000 ballots with double punchmarks out.
3. order a new county-wide election for president.

Depending on what rememdy he thinks he would chose, he will either dismiss the suit or hold an evidentiary hearing. If he thinks he might chose #1 or #2 only, then there is no need for an evidentiary hearing. If #3 is a possibility, he will order an evidentiary hearing to be held within days.
