It is called CAPITAL MURDER.

You really believe the goons that killed Mr. Byrd would give a rats butt about another law calling it HATEFUL???

Oh come on, you're suggesting there isn't a law on the books already that would prevent the horrific actions on a back Texas road. The color of skin isn't the issue. I live in Idaho and a few years ago three white guys brutally tortured and murdered another white guy. THAT'S A HATE CRIME. FWIW, the three white guys did not get the death penalty....unfortunately.
