It wouldn't be Gore, he wouldn't be seated at the time of the vote; his term will have expired. [Assuming you're in that time frame]

I believe this will be resolved more quickly than you suggest. This isn't a Microsoft anti-trust case. The Florida Courts and perhaps the US Supreme Court if necessary will resolve this pretty darn quickly. But it has been a surreal election.

another wrinkle is Leiberman. He will be one of the senators voting for VP, basically himself. If he wins (as a VP candidate), he loses his Senate seat, if he loses, he retains it.
