The question I always have when considering "takings" is what about the "givings" that some property owners receive due to government regulations? For example, re-zoning property from agricultural to high-density residential?

IT could be argued that this is no giving the government is merely reduceing its restrictions (and even the lesser restirctions can reduce the value) on a plot of land. Of course if the buyer bought the land at a low price because of the previous restrictions then he certinly is getting somthing when the price goes up due to due the lest strict restrictions but he is really getting the advantage at the expesne of the person who sold him the land at the depressed price not at the expense of the government.
