Excellent point. The Seventeenth Amendment provides for interim appointments only until there is an election.

"Seventeenth Amendment Clause 2. When vacancies happen in the representation of any State in the Senate, the executive authority of each State shall issue writs of election to fill such vacancies: Provided That the legislature of any State may empower the executive thereof to make temporary appointments until the people fill the vacancies by election as the legislature may direct."

Further, Article I, Section 3 Clause 3 provides that "No Person shall be a Senator who shall not have attained to the Age of thirty Years, and been nine Years a Citizen of the United States, and who shall not, when elected, be an Inhabitant of that State for which he shall be chosen."

Mr. Carnahan was not a "person", because he was dead, and he was not an "inhabitant" of anything because dead people don't have habitats. Someone needs to challenge that immediately.

I applaud Ashcroft's actions...but let's be fair he. He also knew it would be a political liability to have dragged a recent widow through the courts.

BTW, why didn't the Democratic Party of MO simply appoint Mrs. Carnahan as a replacement candidate? In most states, when a candidate dies BEFORE the election, the Party appoints a replacement.
