At this point it would seem that the Dems are better positioned to get an injunction preventing anyone from stopping them doing the manual recount due to the fact that unless they start immediately they may not be able to complete the count by Thursday. That seems like a stronger showing of irreparable harm. Although at this point it wouldn't be granted because no one has done anything to stop the recount. I prefer Busch. It is troubling that they didn't go for a Reason to Show Cause based on the issue of card degradation. I think that argument has a lot more political viability as well.
