Read his complaint. He is suing under 42 USC 1983, the federal Civil Rights Act:

"This is a civil action for declaratory and injunctive relief under Section I of the Civil Rights Act of 1871, 17 Stat. 13, 42 U.S.C. § 1983, and the First and Fourteenth Amendments to the United States Constitution."

The Bush challenge is not based upon any statute, federal or otherwise: it is based on the Equal Protection Clause of the 14th Amendement

Would this be a strictly constructed clause? or does he and James Baker plan to make it up as they go?
