Michael,

I saw the settlement conference date on Yahoo!

According to the court docket there have been several settlement conferences which appear to be supervised by the court. The judge mentioned in the post you linked is not familiar to me. There is one primary jugde (Judge Breyer) and two others that have filled in for him presumably in his absence. Neither are listed on the Yahoo! link.

The file number is, indeed, the patent infringement case that SanDisk iniated against Lexar in 1998.

I am not sure what to make of this development.

Michael, just once I would like to see a judge order the following:

A hearing will be held two weeks from today.

The court will be ready to receive arguments precisely at 9:00 am. No extensions or delays will be permitted. Each party to this suit will have precisely four hours to present their case. If either party to this suit is not ready at that time, a summary judgement will be entered on all counts on behalf of the opposing party. The Judge will then retire for the evening and render his decision at precisely 1:00 pm. the following day.

The only allowable excuse for delaying this proceeding shall be the unexpected death and/or total disability of counsel for either party, provided that same is acknowledged by the County Medical Office prior to the time and date of said hearing. In the unlikely event that either counsel that shall fail to appear at the appointed time -- barring death and/or total disability as described hereinabove -- such counsel shall be summarily disbarred from practicing law in this State for a period of not less than five (5) years.
