Where are you getting your information? It doesn't look like from the Constitution to me. I already cited for you the 12th Amendment describing the controlling passages for the Election of the President. Article II says Four Year Terms all right, but suggests that a President remains until a President shall be elected. I see nothing there about the appointment of the Speaker of the House as President, nor do I imagine that any lawsuits will have any meaning as far as the election goes whether the matter is or is not resolved by the Electoral College.
