The Commissioner of Elections, a Democrat (who voted for Bush) has attempted to clarify the Sec. of State's position on a deadline. The law apparently states "shall" when referring to the consequences of not meeting the deadline. Thus, there is no arbitrary decision involved.

Actually David it is not "enforcement" of Florida Law you are talking about it. There is no mandate that the Florida Secretary of State MUST Certify, the wording is MAY certify. Her insistence that she WILL force certification is allowed under the Law, but it is not ENFORCEMENT. It is rather the exercise of a prerogative to Decide to Certify.

That being the case I think Warren Christopher has a point about her decision to attempt to thwart the re-count process. I suspect that this is not the last we will hear on this issue. There may even be a successful injunction filed against her based on the 14th Amendment wouldn't you know.
