Lml,

I've read the complaint and it is a joke. They don't come close to stating a valid constitutional claim. Their lawsuit failed because they could not satisfy the basic standard for obtaining a preliminary injunction (i) a showing of immediate, irreparable harm and (ii) the likelihood of success on the merits. They could not show a likelihood of successon the merits has they have statue neutral on its face, they have alleged discrimination against a suspect class for which a court will apply anything other than a rational review, there is no precedent to support a right that all votes be counted in the manner and tradition and history support manual recounts subject to local discretion. Don't you think its funny that conservatives who profess to belive in "original intent" of the constitution what the 14th amendment to invalidate manual counting subject to local discretion when at the time the 14th amendment was passed that was all there was. Gore should have hired Bork who has had a lifetime mission against courts inventing new 14th amendment rights that are contrary to history and tradition.
