You are right and you are wrong with respect to the deadline statuteS. There is one that states the secretary of state must certify by a certain time (7 days after the general election). There is also a separate provision, also in the election code, that allows the secretary of state to extend that deadline. Given that the secretary of state is going to find it difficult to justify the harshness of a deadline that falls within the period of time hand-counting is going on and given there is a statutory provision that permits it, I suspect the court will stop the secretary of state from certifying the state election results prior to the conclusion of the hand counts (but also will probably impose a deadline which he/she feels the handcounts should be done by).
