Good news for U.S. wireless carriers wanting to bid on NextWave Telecom Inc.’s C- and F-Block PCS licenses this December. The U.S. Appeals Court for the District of Columbia refused to delay the Dec. 12 sale of radio waves previously controlled by the now bankrupt NextWave.

The licenses were pulled from NextWave after the company defaulted on a $4.2 billion debt from its 1996 auction bid. The FCC reclaimed the frequencies, and the company has been fighting the FCC in several court proceedings, including two petitions to the Supreme Court.

The one glimmer of hope for NextWave? The court has agreed to hear NextWave's argument that the FCC acted illegally when it reclaimed the licenses earlier this year. In an accelerated briefing schedule, the federal appeals court will accept legal briefs on Dec. 11 and final documents on Jan. 31, 2001. NextWave remains confident in the merits of the case. <<
