Most judges decide this as the third rail of presidential politics --- either they let whatever [fill in the blank, whatever it is] stands or they recuse themselves. A reasonable exercise of judicial prudence [not to be confused with jurisprudence :),] I suppose.

At this point, the mkt [and I tend to concur] seems to think the Bush camp has the upper hand. If the conventional wisdom of mail-in ballots applies, that should strengthen the lead. However, there is still a potential for an upset. Even though the GOP was an odd on favor for the military mail-in last time around, it might not be the case this time. Last time, it is b/c of the long standing distrust of President Clinton [and probably Sen Dole's WWII hero status.] This time, it is a journalist versus a home boy. The former got sent to NAM by our then President and the latter got to do duties in Texas, maybe a toss up. Of course, the ex Desert Storm choreographers should throw weight behind the elephant, so I don't think the odd is in the donkey's favor <VBG>
