You're making an assumption about what the court ruling means. Without prejudice means that they have no opinion as to whether or not the suit has merit. By my reading, she could not file the pre-emptive suit until she had something to file about. The lower court ruling stands, a point which I am sure you will have trouble conceding.

It's actually good that the Supreme Court won't get involved...hopefully they won't get involved when the SOS abides by the law and refuses any recounts after the certification deadline...

You should be more concerned with their unwillingness to claim jurisdiction over the law promulgated by the legislature- the law under which Harris derives her authority to not recognize amended tallies after yesterday.

In fact, this might be better for Harris than it is for the vote-riggers.
