I think it is a mistake to say that the SOS was arbitrary - we don't know that yet. If she is smart and well advised (and she has been said to have been acting on guidance of counsel) she will be found to have created written guidelines for accepting votes after the statutory deadline and to have considered the requests for delays in the statutory deadline in light of those guidelines. This would set her up to defend her actions against charges of being "arbitrary and capricious".
