I'm actually not convinced, that it wouldn't be illegal. You have to remember, different rules apply for players in a dominant market position.

Anyway, it would be, as you say, dumb of the game makers to actually make their software run worse on AMD platforms. The reason is quite simple: With 15% or so of the total (x86) market, what do you think AMD's marketshare among gamers is? I'll give ya a hint... even before the Athlon, it was above 50%.
