I have Judge Lewis' Order in McDermott v. Harris (denying motion for a TRO against Harris) open on Adobe Acrobat, but can't figure out how to cut and paste.* It's version 4.05, I think I am going back to version 3. Essentially he is saying that she can't act in an arbitrary manner in enforcing the 5:00 p.m. Tuesday deadline, she has to consider the facts and circumstances. So what she did was order the counties to send her letters giving their facts and circumstances as to why they couldn't meet the 5:00 p.m. Tuesday deadline, and then consider the facts and circumstances and say the reasons given were not good enough. Which is her job and ordinarily would not be subject to reversal if she did not act in, you got it, an arbitrary and capricious manner.
