I have Judge Lewis' Order in McDermott v. So what she did was order the counties to send her letters giving their facts and circumstances as to why they couldn't meet the 5:00 p.m. Tuesday deadline, and then consider the facts and circumstances and say the reasons given were not good enough. Which is her job and ordinarily would not be subject to reversal if she did not act in, you got it, an arbitrary and capricious manner. *I think I figured out the problem, the document is not text, it's an image.
