Not necessary. Any Senator can put a hold on any law, and the Senate is such a courteous place that his wish will be respected. No filibuster is necessary, but a filibuster requires 60 per cent to limit debate.
If the Senate is 50-50 it will either be the most polite and courteous place in history or an absolute madhouse of contention.
Of course, the House was once reasonably polite, and then came Newt!
