But, when there is a contention, the final determination is made by the County election commission which is 2:1 Democratic. So we have ARBITRARY criteria (for example, I doubt very much Republicans would ever agree that a dimpled chad constitutes a vote) and an ARBITRARY decision making process in which the Democrats have the final say. Now.... you can rightfully say that it is, at this time, legal under Fla law and Gore is very likely to win under these terms. But I hardly call it a fair process. And if the final say was up to a Republican controlled election commission, it would not be fair either. In that case, you would not likely have a county wide recount at all. If forced to, you would have had very strict criteria that favored Republicans and contentious ballots would be decided in the Republican's favor. The election is close enough so that even a small bias can decide the outcome. You take a very simple minded approach to this fairness issue. Do you honestly believe this recount is fair or do you simply say that it is legal?
