Dear Ish: Havent you heard? The Leon County Circuit Court Judge in Tallahassee ruled the hand counted votes MAY NOT be included in the election results. His ruling basically says that Ms. Harriss AND THE CANVASSING BOARD did NOT act arbitrarily but instead followed the law in their decision not to include the votes. This of course will be immediately appealed to the Fla. Supreme Court but I myself have taken a case to the Fla. Supreme Court and I can tell you it is next to impossible to get a circuit court judge overturned. They would have to show that he ERRED in his decision which would mean in fact HE acted capriciously in finding SHE acted without being arbitrary. Now, Judge Lewis isnt just any old judge, he is well respected for his fairness and intelligence and is believed to be on the fast track himself to the Supreme Court. He incidentally is a Democrat. I will be SHOCKED if they overturn him. In my case when I took it to the Supreme Court here years ago, they refused to overturn the judge, and my case was CLEAR CUT. Instead the remanded it back to the Judge and ordered her to reconsider, which meant CHANGE YOUR OPINION. haha. JDN
