The law reads that the Secretary of State SHALL end the election process 7 days after election day -minus unforseen circumstances such a hurricane, mechanical failure, or proof of fraud. And the operative word being "SHALL" which is an imperative equal to "MUST", not a term which allows her discretion. For her to upload Florida law, SHE HAD TO DENY THE MANUAL RECOUNT. It is not in authority to over rule the Florida legislation who wrote and passed that law. The conflicting interests here lie between preserving the state and nation's interest in electoral finality, and ensuring that every vote is properly counted. Given that the potential exists where it would be impossible to quickly insure the accuracy of every vote in an election, and in fact, could literally take weeks in the case of statewide Florida manual recount, the state has an interest in certifying the votes in a timely manner in order to insure that Florida voters are represented in the electoral process. There is a serious risk that all of this litigation could deny those Floridians who properly voted and met the standard for casting a valid vote from being disenfranchised by the arbitrary demands of Palm Beach, and other counties involved in manual recounts. And that is a violation of the 14th amendment, which should, btw, provide a Federal Court the jurisdiction to over-rule the Florida Supreme Court ruling late this afternoon. And if can be READILY CITED that Palm Beach has an arbitrary standard with regard to permitting manual recounts. One only has to review the case of the black female republican who lost by 11 votes in her election several months ago. She received one electronic recount and then requested a manual recount, which was denied by the VERY SAME PEOPLE WHO HAVE PERMITTED THE CURRENT RECOUNT. This, despite the fact that Gore won in Palm Beach and now the only thing they are trying to do is disenfranchise the entire state of Florida by stuffing the ballot box with subjective "chad analysis".
