by definition any member of any political party is deemed "partisan"

the judge merely decided based on the law......judges tend not to decide beyond the law or on partisan lines as they typically don't like reversal of their decisions on appeal.

appealate courts can only reverse when an error in deciding the law has been made....very rarely consider the facts, just the law...
