I agree that the issue is whether Lewis acted within the limits of her discretion. I also agree that all the evidence of irregularities piling up -- chads on the floor, affidavits of ballot tampering during the counting, ballot punching machine in car, etc -- support a ruling that her decision was not legally arbitrary.

Would love to read the actual decision.

Also, do you know under Florida law whether the SC will be hearing this as an appeal from a lower court ruling, in which case they must decide whether Lewis made a legal error in his ruling, or de novo, which standard out courts would use if it were considered to be a summary judgment proceeding? Since there were no witnesses or live testimony, I fear the Fla SC might view it as a de novo review, which is less favorable to Bush.
