Boies's ethical responsibilities to the bar are not dependent upon anyone else's politics or actions. Boies stands to make or lose major legal fees from the US TREASURY (spelled, "the surplus"), depending upon who wins the election and the new government's position in the MSFT case. In fact, if I were MSFT, I would look into asking the MSFT court to disqualify Boies from further proceedings. Just the cost of fighting the request, and if successful the cost of bringing on new counsel, should give Boies pause.
