Appeal what? There is no action that can be yet appealed. The matter is before the Appeals Court.

I don't think there are any federal issues in the deadline part of the lawsuit, so the US Supreme Court would have no jurisdiciton. If the federal courts are going to have a say, it's thru GW's federal civil rights action.
