V, I hope you are right.

I am trying not to read into the backgrounds of those individuals. I just hope they give us some sort of ruling in favor of Harris--i don't really care if it is a split decision---like 4 to 3 in favor of Bush.

I am hoping these guys are not partisan. Maybe they got appointed by Democrats who were just looking for good judges. The lower court certainly made it clear that Harris can set the criterea.
