I don't know. Maybe we need to illicit more SI lawyers and get their opinion. Seems awfully strange to me.

I remember after the Elian ruling someone explained to me how courts only rule on the specific issue in front of them. And not on other issues which might relate to the outcome of the case.

Seems like they did exactly the opposite in this case.
