I imagine their confirmation elections could be a bit rocky regardless of how they resolve the case.

True. Their profile has just gone up into the stratosphere. Historically, people know little about them individually and assume they are doing a good job and vote affirmatively. I believe that will change if they do what they seem to be going to do. But, if they do the opposite they will run into the wrath of the Gore people. So, they won't win next time with 80% of the vote.
