Certainly it varies from State to State, but it just so happens I checked with the Attorney General's office in Maryland and the law applies to in person conversations as well; the lawyer there threw in for the heck of it, if you were using one of those parabolic dishes intended for use by birdwatchers, to monitor conversations that would be illegal surveillance as well. Legal monitoring of a conversation requires that all parties are informed of the monitoring activity. Note here that I said monitoring and not recording; it is the monitoring that may be illegal and not the means used.
