That is incorrect..you are possibly referring to "deceptive trade practices". RICO is Racketeer Influenced and Corrupt Organizations act.

For anybody to be charged under the RICO statue the underlying offense has to be criminal. In short, RICO is a tool to be used by a U.S. Attorney's Office to try individuals involved in a continuing criminal enterprise. What you are referring to (three times actual damage) has nothing to do with the RICO statue.

To be convicted in a criminal court (federal level) one of two things must occur. Either the defendant waives indictment and pleads guilty to an "information" or the individual is indicted and the individual stands trial in front of a jury or judge (the defendant has that option of either a jury trial or a trial by a judge).

If you are charged under the RICO statue you are violating criminal law.
