Labor is not an article of Commerce according to the 1914 Clayton Act. Workers are guaranteed the right to engage in concerted acts for purposes of mutual aid or protection. According to the NLRA. Finally, labor is free to organize because capital is free to act collectively in the corporate or other form. (Norris LaGuardia Act 1932).
