First, I think the rally/fizzle yesterday demonstrates that this uncertainty has much to do with these markets. Of course, the DEGREE to which they are connected can be disputed. I don't dispute that.

I think most people fail to see what the Flo situation is shaping up to be. First, it is incredible that the FSC could tell a member of the Executive bracnh what to do before she takes any action. They are limited in their jurisdiction-- they have NO AUTHORITY to tell anyone what to outside the bounds of a lawsuit. The Dems did not ask them to issue an injunction: they did it all on their own. BY WHAT AUTHORITY??? Imagine if the SUpreme COurt of the US told Madeline Albright could not represent the US in a treaty dispute (for example). They have no authority to do that. David Boies talked about ripeness the other day in response to questions-- he was right. There was NO JUSTICIABLE ISSUE before the Flo SC. A meltdown is days away.
